On 14 November 1998, a group of armed protesting residents in Ocean View, Cape Town, gathered and approached the houses of several reputed drug dealers in the area, including the house of one Grant Cronje. They allegedly caused damage to the property of Cronje before moving on. The protestors drove through the area in a motorcade of about five to six vehi
cles. As the motorcade
approached a road intersection Cronje opened fire on the group. In
response, some members of the group alighted from their vehicles and
returned fire. In the resulting crossfire, a seven-year old girl,
Crystal, was fatally shot and two others, John and Lester, were wounded.
After the shooting the members of the protesting group, jumped back in their cars and raced away from the scene, except for one member, Sam, who were unable to get into one of the motor vehicles. He was arrested by the police, who recovered a revolver from Sam. It was not a bullet from Sam’s revolver that killed the girl.
Discuss Sam’s liability as a perpetrator to murder in respect of the seven year old girl.
